By downloading and/or using the IdiomConnect™, IdiomCreate™, or Idiom Event Preservation Platform™ apps and software, (Idiom Products & Services a/k/a Idiom P&S) these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app or any Idiom P&S.
1. User Rights & Responsibilities
You may not copy, modify or duplicate any part of the Idiom P&S or copy, modify, alter or duplicate any of the Idiom trademarks, database rights, copyrights, icons, logotypes or graphic elements. These are proprietary intellectual properties owned by Idiom Publishing Inc., (Idiom) as is the source code for all of the Idiom P&S. You also shouldn't try to translate the app into other languages, or make derivative versions.
1.A. You should be aware that there are certain things that Idiom Publishing Inc. will not take responsibility for. Certain functions of the IdiomConnect™, IdiomCreate™ apps and templates are stored in cloud servers and will require the app to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider. Regardless, Idiom Publishing Inc. will not take responsibility for the Idiom P&S not working at full functionality if you don't have access to Wi-Fi, a secure internet connection or you don't have any of your data allowance left.
1.B. If you're using the Idiom P&S outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing any Idiom services or products (including the Idiom apps), or other third-party charges. In using the Idiom P&S, you're accepting and assuming responsibility for any such charges, including roaming data charges if you use the Idiom P&S outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you're using the Idiom P&S and apps, please be aware that we assume that you have received permission from the bill payer for using the Idiom P&S and apps.
1.C. There's more. Idiom Publishing Inc. cannot take responsibility for the way you use your device (example; smartphone) or the IdiomConnect app. You need to make sure that your device is functional and stays charged – if it runs out of battery and you can't turn it on to avail the Idiom P&S, Idiom Publishing Inc., cannot accept responsibility.
2. Our Commitment
Idiom Publishing Inc. is committed to providing you with Idiom P&S that are useful and efficient as possible. For that reason, we reserve the right to make changes to the app or its services, at any time and for any reason. Once you purchase the IdiomConnect™ app, we will never charge you for the use of the IdiomConnect™ app.
3. Data and Privacy Policy
The Idiom P&S stores and processes personal data that you have provided to us, (Personal Profile) in order to provide our Services. It's your responsibility to keep your phone and access to the Idiom P&S secure.
4. Idiom Publishing will not sell or distribute any of your personal information!
Because you may use the Idiom Products & Services (Idiom P&S) to access outside applications, we have a responsibility to address what may happen when you journey outside the of your protected Idiom P&S. For a complete understanding of the Idiom Data and Privacy Policy click on the link.
4.A. We have tried to use plain language to make our policies understandable. GDPR (General Data Protection Regulation) is the forward-looking EU generated privacy protection regulations. Idiom intends to comply with applicable data protection regulations and is committed to GDPR compliance across its relevant services effective June 11. 2019.
4.B. We suggest that you do not remove software restrictions and limitations imposed by the official operating system of your connectivity device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone's security features and it could mean that the Idiom P&S won't work properly or at all.
5. User-Generated Content
The Idiom P&S may contain information, text, links, graphics, photos, videos or other materials (Content) including User-Generated Content submitted prior to or after publication. The Company encourages you to update your page on a regular basis and chronical your life events.
5.A. By submitting User-Generated Content prior to or after publication to the Idiom P&S, you represent and warrant that you have all rights, power and authority necessary to grant rights to such User-Generated Content contained within these terms. Because you alone are responsible for Your User-Generated Content, you may expose yourself to liability if you post or share Content without all necessary rights.
5.B. Idiom Publishing Inc. will not tolerate any uploading of User-Generated lude language, nudity or pornographic materials. Nor will Idiom Publishing tolerate the use of any explicit language concerning sexual orientation, ethnicity, gender or religious beliefs. Any of the above referenced negative content actions may constitute a "cause" of action that could result in a suspension of service (see below, Static Suspension of Service).
6. Static (Read Only) Suspension of Service
6.A. Our policy is simple and straightforward:
You have purchased and Idiom agrees that your purchase will be perpetually available as an individual IdiomConnect™ End User License Agreement or an IdiomCreate™ design license, and we want you to continue using and enjoying the Idiom P&S.

6.B. "Cause." Under no conditions, should you, for any reason, attempt to post User-Generated content deemed to be socially unacceptable (language, video or photographic).
6.C. Purchasers of IdiomCreate™ template software (staff/advisors) may be made aware of User-Generated and User-Submitted Content that is determined to be objectionable or socially unacceptable content prior to publishing. Staff/advisors are strongly encouraged to refuse to publish such content and identify the submitter. All User-Generated and User-Submitted Content is subject to internal review and determination by Idiom P&S purchaser (staff/advisor) as to its suitability for publication. Objectionable User-Generated and User-Submitted content repeatedly submitted by identified users may constitute "Cause".
Idiom Publishing Inc. objects to the posting of any socially objectionable content and the Company realizes that there are variances in what may constitute "socially unacceptable or objectionable content." Idiom Publishing Inc. strongly suggests that prior to publication, staff/advisor and committee teams carefully review and delete all content that could be considered socially unacceptable or objectionable.
Post publication by the purchaser, Idiom Publishing Inc. may take any and all steps to continue to monitor, identify and remove socially unacceptable or objectionable content. Specific objectionable content should be reported via email to Idiom Publishing Inc.'s "Offensive Content Review" committee.
If you believe that your purchaser account has been placed in "Offensive Content Review" incorrectly, you may contact Idiom via email to our Offensive Content review committee for review. You will be contacted via email as to the result of the committee review and the status of your Idiom account.
7. Fees and Payment
7.A. You agree to pay all applicable, undisputed fees for the Idiom P&S on the terms set forth on the invoice or receipt. Except as set forth in the Service P&S description, any and all payments made to us for access to the IdiomConnect app are final and non-refundable. You are responsible for providing accurate and current billing, contact and payment information to us or a reseller. You agree that we may take steps to verify whether your payment method is valid, charge your payment card or bill you for all amounts due for your use of the Idiom P&S, and automatically update your payment card information using software designed to do so in the event your payment card on file is no longer valid. You agree that your credit card information and related personal data may be provided to third parties for payment processing and fraud prevention purposes. We may suspend or terminate your Idiom P&S if at any time we determine that your payment information is inaccurate or not current, and you are responsible for fees and overdraft charges that we may incur when we charge your card for payment.
7.B. Idiom recognizes that certain Idiom P&S purchasers (Account Holder) may not be the actual "Users" of Idiom P&S. Example: a parent, school or organization may purchase the IdiomYB app for their child or a group of users. As such, the Purchaser (Account Holder) will be required to complete the User Profile as will the sub account "User" (the student or child). All notifications (updates or suspensions) of Service will be sent via email to both the Account Holder and the User.
7.C. License
Upon receiving payment (as described in 7.A.) Idiom Publishing Inc. grants you a revocable, non-exclusive, non-transferable, limited End-User License Agreement to download, install and use the IdiomConnect™ or IdiomCreate™ Application and/or any Idiom P&S solely for your personal, non-commercial purposes strictly in accordance with the terms of this Agreement.
Upon completion of payment and downloading or using any of the Idiom P&S Software or Applications, you are agreeing to be bound by the terms and conditions of this Agreement.
If you do not agree to the terms of this Agreement, do not download or use the IdiomConnect™ Application, IdiomCreate™ Software, or any other Idiom Publishing Inc. Products or Services.
8. Updates
At any point, we may wish to update the Idiom P&S. The Idiom P&S are currently available on iOS and Android platforms. The requirements for platforms and systems (and for any additional systems we decide to extend the availability of the Idiom P&S) may change, and you'll need to download the updates if you want to keep using the Idiom P&S. Idiom Publishing Inc. does not promise that it will always update the Idiom P&S so that it is relevant to you and/or works with the version of the operating platform that you have installed on your device. However, you promise to always accept updates to the application when offered to you, Idiom Publishing Inc. may also stop providing the Idiom P&S, and may place your account in Read Only mode at any time without giving notice of termination to you based on you, breaching of the Idiom Terms and Conditions. Unless we tell you otherwise, upon any suspension or termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.
10. Additional Products and Services
Once your initial purchase and payment has been received for the IdiomConnect™ app or IdiomCreate™ design software, you will never be charged for your perpetual use of the IdiomConnect™ app. However, the Company may offer additional Products and Services, ancillary products, offers or services or offers from affiliates or sponsors that you will not be compelled to purchase.
11. Changes to This Terms and Conditions
Idiom Publishing Inc. reserves the right to update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page. These changes are effective per the dates posted on the Terms and Conditions page immediately after they are posted on this page.
12. Governing Law
These Terms of Service are governed by the laws of the State of New York, United States of America, and all parties submit to the non-exclusive jurisdiction of the courts of this State.
